These terms cover the United Kingdom and do not legally cover access of the Service from any other jurisdiction. You are responsible for all compliance with laws and regulations which apply to you, and you agree to comply with all applicable laws regarding the transmission of technical data exported from the United Kingdom or the country in which you reside (if different) and with all local laws and rules regarding acceptable use of and conduct on the Internet.

1. Definitions

Grampian Business Finder.co.uk is part of This Little Piggy (Scotland) Limited. Our registered company number is SC485654 and our registered virtual office is at Aberdeen Business Centre, 11 Bon Accord Crescent, Aberdeen AB11 6DE. Where we refer to ourselves in this Agreement, this is also taken to include (where the context allows) our group companies, affiliates, and our and/or their employees, associated and contracted persons, and persons supplying services to us or them. You can contact us via our online contact form and on [email protected].

Where we refer to you in these Terms of Use, this also includes any person that accesses or uses our Service on your behalf. The “Terms of Use” include the terms set out here and our Privacy Notice, Values, Verification policy and Complaints policy as made available via the website.

The “Service” consists of the website currently located at www.grampianbusinessfinder.co.uk and www.grampianbusinessfinder.com and any pages we operate on third party social media applications, and the content and services we make available through them via the internet, mobile devices including smart phones and tablets, and/or interactive television devices and services.

2. Acceptance of Terms of Use

Your access to and use of the Service are subject exclusively to these Terms of Use.

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms of Use.

By using the Service you are fully accepting the Terms of Use. If you do not accept these Terms of Use, you must immediately stop using the Service.

Grampian Business Finder reserves the right to update or amend these Terms of Use at any time and your continued use of the Service following any changes shall be deemed to be your acceptance of such changes. It is therefore your responsibility to check the Terms and Conditions regularly for any changes.

Grampian Business Finder updates the Service periodically and may change the content at any time.

3. Other Applicable Terms

The Grampian Business Finder Privacy Notice, Values, Verification policy and Complaints policy as made available via the website apply to Business Members and all other users of the Service wherever relevant.

4. Service Content

Service Business Members are Verified real and insured in accordance with the Verification process included on this website, the Verification process aims to provide additional basic reassurance and peace of mind to customers that Business Members are real and insured – real meaning a real trading entity, and insured meaning public liability and/or professional indemnity insurance is in place (employers’ liability by employers is already required by law). Known substandard businesses are not eligible to join the Service and reviews and feedback are taken into consideration before a Business Member joins.

Qualifications and certifications are not a requirement in every industry. For Customers added peace of mind Business Member profiles on this website include a section for Qualifications, Experience, Accreditations and Awards - these may also be uploaded into Business Members photo galleries (with personal identifying information removed). If a business format changes during Membership rendering the evidence previously provided invalid, the Business Member is required to provide Grampian Business Finder with updated validation immediately to avoid their Membership becoming null and void. Current insurance documentation is requested by Grampian Business Finder from Business Members on the insurance renewal date. Business Members are required to notify Grampian Business Finder immediately if there are any changes to their insurance policies between inception and renewal dates, and to provide the updated documentation immediately to Grampian Business Finder to ensure continued compliance with the Grampian Business Finder verification process.

Customers and Business Members are urged to undertake due diligence when choosing a provider or to work with a customer; this can include looking at their reviews here and on their other online platforms, asking for testimonials, checking out portfolios of previous work, or contacting their previous customers or known associates. If there is any doubt about a provider, we advise to err on the side of caution until all reasonable peace of mind can be obtained or guaranteed.

The vast majority of the material on the Service originates from our users and we have little or no editorial control over the material. We therefore cannot guarantee the accuracy, timeliness, completeness, performance, or fitness for any particular purpose of the material available on the Service. We cannot accept responsibility for errors, omissions, or inaccurate material, and make no warranty that the Service will be uninterrupted or error-free, or that any defects will be corrected.

The reviews and other information found on the Service are provided by users’ clients submitted, not by us. We do not endorse or recommend any particular third-party service. Any review you receive from clients is at your own risk, and we will not be liable for any loss or damage arising out of or in connection with reputation or financial loss (except to the extent that such liability cannot be excluded by law).

5. Service Access

Grampian Business Finder does not guarantee that the Service or any content contained on the Service will always be available or be uninterrupted.

You are responsible for making all arrangements necessary for you to have access to the Service.

Your access to the Service is permitted on a temporary basis only.

Grampian Business Finder may suspend, withdraw, discontinue, or change all or any part of the Service without notice to you.

Grampian Business Finder will not be liable to you for any reason if the Website is unavailable at any time or for any period.

6. Links

It is not possible for us to review all websites which are linked from the Service (or link to the Service), and you should therefore take care when following any link. We cannot accept liability for any loss or damage that may be suffered as a result of following any links. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that Grampian Business Finder has no control over such websites and is not responsible for the content or availability of any such websites.

You may link to the Service homepage or any other pages within the Service, provided you do so in a way that is fair and legal and does not damage or take advantage of Grampian Business Finder’s reputation.

You must not establish a link which suggests any form of association, approval, or endorsement by Grampian Business Finder where none exists.

Grampian Business Finder reserves the right to withdraw linking permission without notice.

7. User Content

Business Members are permitted to upload content. When you upload content to the Service you must ensure that all content uploaded:

• Is accurate, true, up to date, genuine and not misleading
• Is relevant and appropriate
• Complies with applicable law in the UK and in any country     from which the content is posted or viewed and does not promote illegal activity
• Complies with the Privacy Notice and does not disclose any personal or confidential information
• Does not contain material which is or potentially could be defamatory, obscene, aggressive, offensive, hateful, inflammatory, or rude
• Does not infringe the copyright or any intellectual property rights of any person and where such content relates to an image, you must ensure that all necessary consents and authorisations have been obtained
• Does not promote discrimination based on race, sex, religion, nationality, disability, gender, sexual orientation, or age
• Does not relate to the services provided by Grampian Business Finder without prior authorization
• Does not have the purpose or effect of advertising, discussing, or commenting on third party businesses who are or are not a Business Member
• Is not threatening, abusive or invasive of others’ privacy or causing annoyance, inconvenience, or needless anxiety
• Does not impersonate any person or misrepresent identities or affiliations; or
• Does not give the impression that it emanates from Grampian Business Finder (unless it is the case)

8. Content Standards

• Where content you upload might not comply with the Content Standards or requires clarification, Grampian Business Finder may contact you for further information before such content is approved.
• You warrant that all content you upload shall comply with the Content Standards, and you agree to indemnify Grampian Business Finder for any loss Grampian Business Finder suffers as a result of your failure to comply with the Content Standards.
• Grampian Business Finder will not be responsible, or liable to any third party, for the content or accuracy of any content uploaded by you to the Website.
• Grampian Business Finder reserves the right to remove or withhold any content at any time which it considers fails to adhere with the Content Standards set out in section 5.
• Grampian Business Finder reserves the right to edit content you upload to amend spelling, grammar, punctuation, length, for the purposes of clarity and to ensure that the content can comply with the Content Standards.

9. Content Relevancy and Speed of Response

The content contained on the Service is provided for general information only. It is not intended to amount to advice on which you should rely.

While Grampian Business Finder makes reasonable efforts to update the information on the Service, please note that the content contained on the Service may be out of date at any given time and Grampian Business Finder is under no obligation to update it.

In case of customer emergencies, Grampian Business Finder aims to put customers in touch with Business Members who are able to provide emergency call outs. Grampian Business Finder cannot however guarantee a specific response time and will not be liable for the failure of any Business Member to succeed in providing a service in a specific timeframe.

Any pricing if displayed is offered by a Business Member and is not underwritten or approved by Grampian Business Finder. Any agreement reached between a customer and Business Member is based on this or any other pricing structure is a contract between the customer and Business Member and Grampian Business Finder is not party to this.

10. User Categories

Business Members are entitled to select the number of categories on the website defined in the packages and MUST be insured to deliver all selected categories.

Two categories per membership are allocated for Facebook tagging purposes – these two categories should last for the duration of membership.

If categories are required to be changed, in exceptional circumstances this will be considered on a case-by-case basis.

If a category is not fulfilled a current Business Member may receive tags for that category as freebies until a dedicated member for that category comes on board.

Some examples of category distinctions are (this is not an exhaustive list):

• Plasterer
• Tiler

LANDSCAPING AND GARDENING

• Gardening and maintenance
• Landscaping
• Hard landscaping
• Fencing and garden gates
• Garden sheds

Conversely, when a Business Member is not requested very often on Facebook, they may receive more than two category tags, this is with a view to Grampian Business Finder being as fair and valuable as possible.

11. Facebook Admin Availability and Tagging

Facebook admins are as proactive as possible in manning the free Facebook group, but the group is not covered on a 24/7 basis.

To provide as much coverage and tagging as possible, admins cover the group whenever they can, which in return allows them the necessary time off they need. Guaranteeing coverage from 9 to 5 on weekdays has been considered and deemed this would reduce the value to business and individual members.

12. Payments

If payment is made and the user changes their mind about being a Business Member, they can pause their membership until a more suitable time for them, any relevant administration fees will be passed on to the user in the event of payment being refunded.

13. Viruses

While all reasonable measures are taken to prevent misuse of our systems, Grampian Business Finder cannot guarantee that the Website will be secure or free from bugs, viruses, or malicious code.

Grampian Business Finder will not be liable for any loss or damage caused by a virus, transmission of malicious code, or any other technologically harmful material that may infect your computer equipment, data, computer programs or other proprietary material due to your use of the Service or to your downloading of any content on the Service, or linked to the Service, where Grampian Business Finder has taken reasonable security to prevent this.

We recommend that you always use up-to-date firewalls and anti-virus software to protect your equipment and data.

14. Use of Information

You agree not to copy, reproduce, modify, create derivative works from, distribute or publicly display any content (except for your own information or content which is shareable by share button or url) from the Service without our prior written permission.

You consent to information about the device you use to access the Service being collected and processed for fraud prevention purposes and we may use third parties (and information they provide) to help us prevent fraud or unauthorized access to our Service.

You agree to use the Service for lawful purposes only and not:

• In any way that breaches any applicable local, national, or international law or regulation
• In a way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect
• For the purposes of harming or attempting to harm any person, business, or entity in anyway
• To undermine the purpose and provision of Service
• To gain a competitive advantage over any businesses in your sector
• To act in competition with the Service
• To violate the privacy of others
• To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of solicitation
• To reverse engineer, decompile, dissemble, decipher, or otherwise derive the code used on the Service
• To use any robot, spider, scraper, or other automated means to access the Service
• To reproduce, duplicate, copy, sub-license, broadcast, distribute, sell, re- brand or re-sell any part of the Service without Grampian Business Finder’s consent

15. Intellectual Property Rights

You acknowledge that all present and future copyright and other intellectual property rights subsisting in, or used in connection with, the Service or any part of it (the “Rights“), including the manner in which the Service is presented or appears and all information and documentation relating to it is our property (or that of our licensors), and nothing in these Terms of Use shall be taken to transfer any of the Rights to you.

Solely for the purposes of receiving the Service, we hereby grant to you for the period during which the Service is provided a non-exclusive, non-transferable license to use the Rights.

None of the content contained on the Service may be downloaded, copied, reproduced, transmitted, stored, sold, or distributed without our prior written consent. This excludes the sharing, downloading, copying and/or printing of pages of the Website for personal, non-commercial use or for use by Grampian Business Finder verified Business Members or their supporters in promoting their business.

When you upload any content (including text or photographs) to the Website, you assign all rights in such content to Grampian Business Finder.

You agree to Grampian Business Finder using the name you submit in connection with the content you upload.

You agree that once you have submitted content, the content will become the property of Grampian Business Finder and you cannot recall any part of such content.

16. Limitation of Liability

Notwithstanding any other provision, nothing in these Terms of Use shall be construed so as to exclude or limit the liability of Grampian Business Finder for death or personal injury caused as a result of the negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited of Grampian Business Finder or that of its employees or agents.

Use of the Service is at your own risk. The Service is provided on an as seen and as available basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, and accuracy.

If you are dissatisfied with the Service or any of these Terms of Use, your sole remedy under these Terms of Use shall be to discontinue use of the Service.

While Grampian Business Finder makes reasonable efforts to ensure that all information provided is accurate, we make no warranty that the Service will meet your requirements, that the content will be accurate or reliable, that the functionality of the Service will be uninterrupted or error free, that defects will be corrected or that the Service or the server that makes them available are free of viruses or anything else that may be harmful or destructive.

Whilst every effort is made to verify statements and information submitted by the Service users and Grampian Business Finder Business Members, the information compiled by Grampian Business Finder is based on information supplied by various individuals and businesses; it does not represent the views of Grampian Business Finder and we cannot be held responsible for any omissions or inaccurate claims that may appear.

Users of the Service do hereby represent, understand, and expressly agree that Grampian Business Finder does not make any warranty or guarantee over the quality, integrity, timing, responsibility, legality, or any other aspect whatsoever of the materials or services offered or delivered by its Business Members to their customers.

You hereby expressly agree not to hold Grampian Business Finder or our agents, representatives, advertisers or employees liable for any instruction, advice or services delivered which originated through the Service or associated Services of Grampian Business Finder and we expressly disclaim any liability whatsoever for any damage, suits, claims, and/or controversies that have arisen or may arise, whether known or unknown to us.

Grampian Business Finder will not be liable to you for any loss suffered (even if such loss is foreseeable) in relation to your use or inability to use the Service, any inaccuracies or delays on the Service or any reliance by you on content contained on the Service.

Without limiting the foregoing, we shall have no liability for any failure or delay resulting from any matter beyond our reasonable control.

Other than as set out in this Limitation of Liability section, and notwithstanding any other provision of these Terms of Use, we shall not be liable in contract, tort, negligence, statutory duty, misrepresentation or otherwise, for any loss or damage whatsoever arising from or in any way connected with these Terms of Use.

Save as expressly set out herein, all conditions, warranties and obligations which may be implied or incorporated into these Terms of Use by statute, common law, or otherwise and any liabilities arising from them are hereby expressly excluded to the extent permitted by law.

To the extent permitted by law, Grampian Business Finder shall not be liable for any indirect or consequential loss of business, loss of profits, business interruption, loss of business information, loss of data, or any other pecuniary loss or damage whatsoever (even where we have been advised of the possibility of such loss or damage), arising from the use of the Service.

In the event that any limitation or exclusion of liability in these Terms of Use proves ineffective, then we shall not be liable to you for more than £100 in aggregate. If you register on the Service, then only the aggregate cap on liability under the agreement which you enter into upon registration shall apply.

We cannot guarantee the day or time that we will respond to any email, telephone or written enquiries or Website form submissions other than it will be as soon as possible.

Each of the provisions of this Clause shall be construed separately and independently of the others.

Nothing in these Terms and Conditions shall affect your statutory rights as a consumer.

17. Indemnity

You agree to indemnify and hold Grampian Business Finder and its employees and agents harmless from and against any breach by you of these Terms and Conditions and any claim or demand brought against Grampian Business Finder by any third party arising out of your use of the Service and/or any Content submitted, posted or transmitted through the Service, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by Grampian Business Finder in consequence of your breach of these Terms and Conditions.

18. Our Rights

We reserve the right at all times to edit, refuse to post, or to remove from the Service any information or materials for any reasonable reason whatsoever, and to disclose any information we deem appropriate to satisfy any applicable law, regulation, legal process, police request or governmental request.

We reserve the right to determine at our discretion whether you have failed to comply with these Terms and Conditions and commence legal proceedings against you if necessary.

We reserve the right to restrict your access to the Service at any time without notice for any reasonable reason whatsoever.

Without prejudice to the generality of the above, we reserve the right to restrict your access to the Service at any time without notice in the event that we suspect you to be in material breach of any term of these Terms of Use.

We reserve the right to modify or discontinue temporarily or permanently all or part of the Service with or without notice without liability for any modification or discontinuance.

We may vary these Terms of Use from time to time and shall post such alterations on the Service.

19. General

Clause headings are inserted for convenience only and shall not affect the interpretation of these Terms of Use.

If any provisions hereof are held to be illegal, invalid, or unenforceable for any reason such provisions shall be severed and the remainder of these Terms of Use shall remain in full force and effect unless the business purpose of these Terms of Use is substantially frustrated, in which case they shall terminate without giving rise to further liability.

You may not assign, transfer or sub-contract any of your rights hereunder without our prior written consent. We may assign, transfer or sub-contract all or any of our rights at any time without consent.

No waiver shall be effective unless in writing, and no waiver shall constitute a continuing waiver so as to prevent us from acting upon any continuing or subsequent breach or default.

These Terms of Use constitute the entire agreement as to its subject matter and supersede and extinguish all previous communications, representations (other than fraudulent misrepresentations) and arrangements, whether written or oral.

You acknowledge that you have placed no reliance on any representation made but not set out expressly in these Terms of Use.

Any notice to be given under these Terms of Use may be given via e-mail, regular mail, or by hand to the address provided on the Website or otherwise as notified by one party to the other.

Nothing herein shall create or be deemed to create any joint venture, principal-agent, or partnership relationship between the parties and neither party shall hold itself out in its advertising or otherwise in any manner which would indicate or imply any such relationship with the other.

Notwithstanding any other provision in these Terms of Use a person who is not a party hereto has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce these Terms of Use.

These Terms of Use shall be subject to the laws of Scotland and the parties shall submit to the exclusive jurisdiction of the Scottish courts.
